Terms of Service

These Terms govern your use of TapIn and related services.

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and TapIn, LLC, a Missouri limited liability company (“TapIn,” “we,” “us,” or “our”), governing your access to and use of the TapIn mobile application and related services (collectively, the “Service”). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

1. About the Service

TapIn is a mobile platform designed to facilitate social connections, user matching, and communication, with a particular focus on users who are relocating or exploring new communities. The Service enables users to create profiles, discover other users, and communicate through the platform. TapIn does not provide housing, employment, transportation, or any other services beyond the platform itself.

2. Eligibility

You represent and warrant that you are at least eighteen (18) years of age and possess the legal capacity to enter into a binding agreement under applicable law. You further agree to comply with all applicable local, state, and federal laws in connection with your use of the Service. TapIn reserves the right to refuse access to any individual at its sole discretion where permitted by law.

TapIn, LLC is a Missouri limited liability company with a principal place of business located at 16618 Caulks Creek Rdg, Wildwood, MO 63005. You may contact TapIn regarding these Terms at admin@tapin.llc.

4. User Accounts and Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to take reasonable measures to safeguard your login information and to notify TapIn immediately of any unauthorized access or suspected breach of security. TapIn shall not be liable for any loss or damage arising from your failure to comply with these obligations. We reserve the right, in our sole discretion, to suspend, restrict, or terminate your account at any time, with or without notice, including where we reasonably believe you have violated these Terms, applicable law, or created risk or potential legal exposure for TapIn or its users.

5. User Content and License

You retain ownership of any content that you submit, post, or transmit through the Service (“User Content”). By submitting User Content, you grant TapIn a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, adapt, publish, display, and distribute such content for purposes of operating, maintaining, improving, and enforcing the Service. You represent and warrant that you have all necessary rights to grant this license and that your content does not violate any law or third-party rights.

If you provide TapIn with any feedback, suggestions, feature requests, or ideas (“Feedback”), you agree that TapIn may use such Feedback without restriction or compensation to you. TapIn shall have no obligation to keep Feedback confidential or to credit you for it.

6. Acceptable Use and Prohibited Content

You agree not to use the Service in any manner that is unlawful, harmful, abusive, deceptive, or otherwise objectionable. Prohibited conduct includes, without limitation:

  • Harassment, stalking, threats of violence, or intimidation of any person;

  • Impersonation of any person or entity, or misrepresentation of identity, age, location, affiliation, or intentions;

  • Fraud, scams, solicitation, spam, or sending unsolicited commercial communications;

  • Posting or transmitting hate speech, discriminatory content, or content that promotes violence or exploitation;

  • Sexual harassment, non-consensual sharing of intimate images, or sexual exploitation of any person;

  • Posting private information about others without their consent (including phone numbers, addresses, or financial information);

  • Using bots, scrapers, data mining tools, or automated methods to access or collect data from the Service;

  • Attempting to bypass security controls, introduce malware, or interfere with the proper functioning of the Service;

  • Creating multiple accounts after suspension or termination;

  • Using the Service for illegal housing, employment, immigration, lending, or other discriminatory purposes;

  • Any commercial use of the Service without TapIn’s prior written consent.

TapIn reserves the right to investigate any suspected violations and to take appropriate enforcement action.

7. Safety Disclaimer and User Interaction Risk

TapIn does not conduct criminal background checks, identity verification, or screening of any kind on its users unless expressly stated otherwise. TapIn makes no representations or warranties regarding the identity, background, intentions, suitability, availability, compatibility, or conduct of any user.

You understand and agree that:

  • Your interactions with other users, whether online or in person, are solely at your own risk;

  • You should exercise caution and good judgment when interacting with others, particularly when meeting in person;

  • TapIn is not responsible for the conduct of any user on or off the platform;

  • TapIn is not liable for any harm, loss, or damage arising from your interactions with other users.

TapIn reserves the right to remove any user from the platform based on safety risks, user reports, or suspected misconduct, even where misconduct cannot be independently verified. You agree to report unsafe or concerning conduct to TapIn using the in-app reporting features or by contacting admin@tapin.llc.

8. Content Moderation and Enforcement

TapIn reserves the right, but not the obligation, to monitor, review, remove, or restrict access to User Content at its discretion. Moderation may be performed using automated tools, human review, or a combination of both.

Enforcement actions may include warnings, content removal, temporary suspensions, or permanent bans, depending on the severity and nature of the violation. If your account is suspended or content is removed, you may appeal by contacting admin@tapin.llc with a written explanation. TapIn will review appeals in good faith but retains final discretion over enforcement decisions. TapIn may also cooperate with law enforcement authorities where required.

9. Messaging and Communications

You acknowledge that communications sent through the Service may be stored, processed, and reviewed by TapIn for purposes of safety, fraud prevention, and enforcement of these Terms. Messages between users are not end-to-end encrypted and may be accessed by TapIn for the limited purposes described above. TapIn may disclose such communications where required by law or where necessary to protect the rights, safety, or integrity of the platform and its users. Deleted messages may be retained in backup systems or safety logs for a limited period.

10. Intellectual Property

All rights, title, and interest in and to the Service, including all software, technology, content, design, and trademarks, are owned by TapIn or its licensors and are protected by applicable intellectual property laws. You are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes only.

11. Copyright Complaints  (DMCA Policy)

TapIn respects the intellectual property rights of others and expects its users to do the same. If you believe that any User Content infringes your copyright, you may submit a written notice to our designated agent at admin@tapin.llc. Your notice must include:

  • A description of the copyrighted work you claim has been infringed;

  • A description of the content you claim is infringing, and its location on the Service;

  • Your contact information (name, address, telephone number, and email address);

  • A statement that you have a good faith belief that the use is not authorized;

  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf;

  • Your physical or electronic signature.

TapIn may remove or disable access to allegedly infringing content upon receipt of a valid notice. Users who repeatedly infringe third-party copyrights may have their accounts terminated. If you believe your content was removed in error, you may submit a counter-notice to admin@tapin.llc.

12. Future Paid Features

TapIn may introduce paid features, subscriptions, or other monetized services in the future. If such features are implemented, pricing and applicable terms will be disclosed at that time. Payments may be processed through third-party platforms, including mobile app marketplaces, and may be subject to additional terms imposed by those providers. TapIn’s total liability for any paid features shall not exceed the amounts actually paid by you to TapIn in the twelve (12) months preceding the claim.

13. Termination

TapIn reserves the right, in its sole discretion, to suspend or terminate your access to the Service at any time, with or without notice. Upon termination, your right to use the Service will immediately cease. TapIn may retain or delete your information in accordance with its Privacy Policy, and certain provisions of these Terms shall survive termination.

TapIn also reserves the right to add, modify, suspend, limit, or discontinue any feature or aspect of the Service at any time, with or without notice, and shall not be liable for any resulting changes or unavailability of the Service.

14. Disclaimer of Warranties 

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAPIN DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TAPIN DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TAPIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, GOODWILL, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY, STATUTE, OR OTHERWISE), AND EVEN IF TAPIN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL TAPIN’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100.00) OR (B) THE TOTAL AMOUNTS PAID BY YOU TO TAPIN IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. THESE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY FOR CERTAIN CLAIMS, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

16. Indemnification

You agree to indemnify, defend, and hold harmless TapIn, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

17. Dispute Resolution and Arbitration

You agree to first attempt to resolve any dispute with TapIn informally by contacting us at admin@tapin.llc. If the dispute cannot be resolved informally within thirty (30) days, it shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as otherwise provided herein.

You and TapIn each waive the right to a jury trial for any claims subject to this section. Arbitration shall be conducted in the State of Missouri or, at your election, by video or telephone. TapIn will pay AAA filing fees for consumer claims where required under AAA Consumer Rules. Each party shall bear its own attorneys’ fees unless the arbitrator finds a claim to be frivolous.

CLASS ACTION WAIVER: YOU AGREE TO WAIVE ANY RIGHT TO PARTICIPATE IN OR BRING CLASS ACTIONS, CLASS ARBITRATIONS, REPRESENTATIVE ACTIONS, OR PRIVATE ATTORNEY GENERAL ACTIONS. ALL CLAIMS MUST BE BROUGHT ON AN INDIVIDUAL BASIS.

If a large number of similar consumer claims are filed, TapIn and the claimants may be required to participate in a coordinated mass arbitration proceeding as determined by the AAA.

Notwithstanding the foregoing, TapIn may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights, prevent platform abuse, or address scraping, security threats, or other irreparable harm. Claims eligible for small claims court may be brought in that forum without arbitration.

You may opt out of this arbitration provision within thirty (30) days of first accepting these Terms by emailing admin@tapin.llc with the subject line “Arbitration Opt-Out.” If any portion of this arbitration provision is found unenforceable, the remainder shall remain in effect.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict-of-law principles.

19. Electronic Communications Consent

By creating an account and using the Service, you consent to receive electronic communications from TapIn, including legal notices, policy updates, service announcements, account notifications, and transactional messages. You agree that electronic notices satisfy any legal requirements that communications be in writing. TapIn may provide notices via email to the address on your account, through in-app notifications, or by posting to the Service.

20. Export Controls and Sanctions Compliance

You represent and warrant that you are not located in, organized under the laws of, or ordinarily resident in a jurisdiction subject to comprehensive U.S. sanctions, and that you are not listed on any U.S. government restricted-party list, including the OFAC Specially Designated Nationals list. You agree not to use the Service in any manner that would violate applicable U.S. export control or sanctions laws.

21. Third-Party Platforms

If you access or download the Service through Apple’s App Store, the following additional terms apply:

  • Apple Inc. is not a party to these Terms and is not responsible for the Service;

  • Apple has no obligation to provide maintenance, support, or warranty services for the Service;

  • In the event the Service fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; Apple has no other warranty obligations with respect to the Service;

  • Apple is not responsible for addressing any claims by you or any third party relating to the Service;

  • Apple is a third-party beneficiary of these Terms with respect to your use of the Service on Apple devices, and Apple has the right to enforce these Terms against you.

If you access or download the Service through the Google Play Store, you agree to comply with Google’s applicable terms of service. TapIn is not responsible for the policies or practices of Google or any other third-party platform.

22. Privacy Policy

Your use of the Service is also governed by TapIn’s Privacy Policy, which is incorporated herein by reference. The Privacy Policy explains how TapIn collects, uses, discloses, and protects your personal information. By using the Service, you acknowledge and agree to the terms of the Privacy Policy.

23. Change to Terms

TapIn reserves the right to modify these Terms at any time. For material changes, TapIn will provide notice via email to the address on your account or through a prominent in-app notification at least ten (10) days before the changes take effect. Updated Terms will also be posted with a revised effective date. Your continued use of the Service following the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

24. Beta Program

TapIn may offer limited beta access to certain users prior to public launch. Beta features may be modified, interrupted, or discontinued at any time.
